Abhik’s practice focuses on patent prosecution in a wide array of industries and technologies, counseling clients in the development of licensing agreements, strategic intellectual property plans and confidentiality agreements and conducting patent due diligence review in support of patent portfolio acquisition including assertion analysis.
Abhik works with start-up companies, solo inventors and large multinational companies on a variety of intellectual property issues. Abhik successfully re-structured and negotiated stalled license and development agreements between a start-up pharmaceutical company, a large multinational pharmaceutical manufacturing company and a medical research university. Abhik counseled an industry leading marketing and management company by evaluating their patent portfolio with respect to scope of protection and assertion analysis. Abhik drafted a licensing agreement template for a large multinational imaging and medical device company for use as part of their licensing program.
Abhik analyzed patents and litigation documentation in response to third party assertions, discussed business risks, strategies and prepared answers to third party assertions for a large international cable and networking corporation. He reviewed and advised on indemnification issues related to third party assertions in cable networks, cable equipment and wireless technologies. He provided license agreement review and interpretation that was used as leverage for concluding a favorable new agreement. Abhik has also conducted patent and litigation due diligence review in support of a $10M+ asset acquisition and merger, resulting with a new subsidiary of an international corporation.
He prepared and revised private placement memoranda for a start-up technology company, assisted in developing a strategic intellectual property plan supporting specific business objectives, and facilitating funding. Abhik critically reviewed existing patent portfolios and formulated, prepared and managed strategic filings both in the U.S. and abroad specifically directed to particular market segments and competitors for wireless technology, healthcare information technology and RFID systems. He has formulated search strategies, managed searches and prepared invalidity opinions, ultimately resulting with potential plaintiffs abandoning claims of patent infringement.
Abhik provided broad-based intellectual property counseling for seed- and early-stage companies, supporting growth and funding efforts. Managed the day-to-day operations of an intellectual property group. Evaluated invention disclosures and designed and managed patent portfolios, representing more than 1,000 properties. He has also negotiated and provided due diligence for multiple transactions having an aggregate value of more than $25M, drafted license agreements, development agreements, letters of intent and other related documentation. Abhik has substantial experience dealing with issues related to contracts, patents, trademarks, copyrights, license terms, confidentiality issues and other such matters.
