After the Grant – When a Patent Needs More Work

Post-patent grant proceedings picks up where patent prosecution stops: an issued US patent may require additional correcting, amending or challenging.  Errors identified after the issuance of the patent may necessitate filing a reissue application.  As the patent owner, you may wish to have the USPTO review it to raise the question of its patentability by ex parte reexamination, perhaps as a proactive measure before an outside party files an inter partes review against your innovation.

Volpe and Koenig is there – to help correct errors in issued patents such as wordings and drawings, and even broaden the original patent when the reissue application is filed within two years of the date of the patent grant.  Avoiding litigation is always preferable, and an ex parte reexamination could fill this need by proving the patent again deemed valid, sparing the time and cost required for a full infringement lawsuit.

Giving you room for alterations, corrections, growth and protection from litigation, Volpe and Koenig keeps your issued patents on track during the reissue and reexamination processes.
