Volpe Koenig’s approach to portfolio management starts with client partnering. We then implement prioritized prosecution protocols based on ranking and classification. These protocols may include jurisdiction-based case handling, development of strategic claim language to strengthen validity and/or improve the likelihood of infringement, and continuation strategies to maintain flexibility. For certain ranks or classes of applications, continuation strategies that maintain flexibility and preserve clients’ ability to realize value from a patent family for the duration of the lifecycle may be desirable. For some applications, we also suggest creating claim charts that focus prosecution strategy and result in valuable issued patents.
